dryerballs Ltd achieved a major mile stone in its enforcement activities with a favourable ruling on the merits heard by a Higher District Court in Germany. After legal proceedings in the Lower District court in Frankfurt, a case was heard in a court of Second Instance. The Higher District Court ruled in favour of dryerballs Ltd and confirmed that the iconic shape of the dryerballs Ltd product is exclusive and protected by unfair competition law.
As a second instance decision in proceedings on the merits it clearly sets a precedent for all future actions in Germany. Thus, the dryerballs® product enjoys an exclusive position in Germany and dryerballs® has and will continue to successfully defend its iconic, market marker product across Europe.
